Article 35 of
the Constitution of J&K provides that there shall be a Council of
Ministers with the Chief Minister as the head to aid and advise the
Governor in the exercise of his functions. The Chief Minister is
appointed by the Governor. The other Ministers are also appointed by
the Governor on the advice of the Chief Minister. The Council of
Ministers is collectively responsible to the Legislative Assembly. The
total number of Ministers including the Chief Minister, appointed under
Section 36 read with Section 38 of the State Constitution shall not
exceed 20% of the total membership of the State Legislature.
